Further developments in asymptomatic pleural plaques compensation laws
Two Bills seeking to permit compensation for asymptomatic pleural plaques under existing laws are progressing through Parliament.
The Bills follow the precedent set by the case of Johnston vs NEI International Combustion during which it was ruled that pleural plaque claims were no compensatable under current laws and its consequent over-ruling by the introduction in Scotland of the ‘Damages (Asbestos-related Conditions) (Scotland) Act 2009’.
If the Bills go through, they will over-rule the precedent for the rest of the UK, as has already been done in Scotland.
Minister of State, Michael Wills said that is "not possible to give a firm indication of what the Government’s ultimate position on the Bill will be. However, on that basis I can confirm that I am content for the Bill to proceed today."
