60% of commercial tenants unaware of legal asbestos duties
60 per cent of businesses that have responsibility for non-domestic buildings are unaware of their legal asbestos duties, according to new research.
The Health & Safety Executive (HSE) and Institute for Employment Studies have found that in addition three in five businesses haven’t yet done an asbestos survey of their premises, or put asbestos management arrangements in place.
The HSE says the duty holder is the person or organisation that has clear responsibility for the maintenance or repair of non-domestic premises through an explicit agreement such as a tenancy agreement or contract.
This year and next inspectors will be checking that businesses are complying with the relevant law, the Control of Asbestos Regulations 2006.
In particular they will be checking that the location and condition of asbestos containing materials has been established, there is an asbestos management plan in place and it is being followed.
